Legal possession and fragmentation of historical heritage:
The impact of property registration tools and urban planning on the integrity of archaeological sites (Al-Suwayjani Palace in Lebanon as a case study)

يعالج البحث "قصر السويجاني" في قرية الكحلونية – الشوف (لبنان)، بوصفه مختبرًا معرفيًّا لدراسة العلاقة بين أدوات تسجيل الملكية والتخطيط العمراني وحماية التراث المبني في لبنان. وتنطلق الدراسة من فرضيّة أن آليات التحديد والتحرير العقاري أسهمت في تجزئة الفضاء التاريخي إلى وحدات منفصلة، مما أضعف البنية المكانية للموقع، وعرّضه لضغوط عمرانية ومادية متراكمة.
يعتمد البحث منهجًا تحليليًّا يدمج المراجعة القانونية، والتقارير الأثرية، والتحليل المكاني، لكشف الفجوة الهيكلية بين القيمة التاريخية للموقع، وغيابه عن أدوات التنظيم المدني. ويخلص البحث إلى توصيات عملية وقانونية تؤكد ضرورة إدراج الموقع ضمن منظومة الحماية الوطنية، وتفعيل التنسيق بين الإدارات العقارية والتخطيطية والأثرية لصون التكامل التراثي.

Abstract:
This research examines "Qasr al-Suwayjani" in Kahlouniyeh – Chouf, as an epistemic laboratory to study the relationship between property registration tools, urban planning, and built heritage preservation in Lebanon. The study proceeds from the hypothesis that cadastral demarcation mechanisms have fragmented historical space into separate units, weakening the site’s spatial structure and exposing it to cumulative urban and physical pressures. Adopting an analytical methodology combining legal review, archaeological reports, and spatial analysis, the research reveals a structural gap between the site's historical value and its absence from urban planning instruments. It concludes with practical and legal recommendations emphasizing the need to integrate the site into national protection frameworks and enhance coordination among cadastral, planning, and archaeological authorities to safeguard heritage integrity.
